Terms of Service
Effective date: October 1, 2026
Agreement
By installing, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The service
warmUP is a PC game launcher and library client. Features may include library management, game imports, launcher integrations, metadata, artwork, discovery feeds, display and controller tools, a browser, social features, subscriptions, advertising, AI assistance, and in-app news or release notes.
We may add, change, suspend, limit, or remove features at any time. Some features may be beta, region-limited, account-gated, subscription-gated, or dependent on third-party services.
2. Eligibility and accounts
You must be old enough to enter a binding contract in your jurisdiction. Some features require a warmUP account or a linked third-party account. You are responsible for keeping your device, account credentials, OAuth sessions, and linked accounts secure.
You can delete your account and personal data at any time in Settings → Privacy → Delete account, or without signing in through our public data deletion form at https://www.warmup-gamelauncher.com/data-deletion. Verified deletion requests are completed within 30 days, except where retention is required by law. Deleting data does not by itself cancel a paid plan.
3. Third-party services
warmUP uses and integrates with third-party services, including Cloudflare, Coolify, Supabase, Stripe, PostHog, Sentry, OpenRouter and model providers, Google / YouTube, Twitch / IGDB, SteamGridDB, Discord, Steam, Epic Games, GOG, Amazon Games, Ubisoft, EA, Battle.net, and similar services. Your use of those services may be subject to their own terms, privacy policies, developer policies, account rules, rate limits, and availability.
We do not control third-party services and are not responsible for their content, downtime, policy changes, account decisions, API limits, payment decisions, or data practices. You must comply with the rules of each third-party service you connect or access through warmUP.
4. Subscriptions, billing, and plans
Paid plans may be offered through Stripe Checkout and managed through Stripe or warmUP account flows. Prices, billing periods, features, ad reductions, Plus add-ons, renewal terms, taxes, refunds, and cancellation rules are shown in the checkout flow or product copy that applies at the time of purchase.
Subscription status is enforced by the backend and may require account sign-in, network access, device attestation, and successful Stripe webhook processing. If a billing or entitlement check fails, we may grant, deny, delay, or revoke access according to the active subscription state and applicable law.
Right of withdrawal (EU/EEA consumers). If you are a consumer in the EU/EEA, you have the right to withdraw from a purchase within 14 days without giving reasons. For paid digital content and services, you expressly agree that performance begins immediately upon purchase and acknowledge that your right of withdrawal lapses once performance has fully begun with your prior consent. We provide withdrawal instructions and a model withdrawal form in the checkout flow and on request at the contact address below. This does not affect any mandatory statutory withdrawal or cancellation rights.
5. Advertising and sponsored content policy
The free tier and some non-Plus experiences may include sponsored tiles, feed placements, hero placements, house ads, partner ads, subscription upsells, or similar promotional surfaces. Sponsored content should be identified with labels such as “Sponsored” or equivalent copy.
Live ads are selected and measured through the warmUP Ad Center at ads.warmup-gamelauncher.com. The App may request eligible ads, cache creative assets, record impressions, record clicks, and retry queued events when offline. Clicking an ad or sponsored link may open a partner website or external URL, where that partner’s own terms and privacy policy apply.
The free tier includes sponsored placements as described in the App. Subscription tiers may reduce or remove some ad surfaces only as described at checkout or in active product copy. Settings do not provide a general switch to disable advertising on the free tier. You may not manipulate, falsify, block, or abuse ad delivery, measurement, or labeling systems except where mandatory law gives you a non-waivable right to do so.
6. YouTube, videos, and soundtrack suggestions
warmUP may use the YouTube Data API and YouTube embedded player for trailers, discovery videos, and optional soundtrack previews. By using warmUP features that access YouTube API Services or embedded YouTube playback, you also agree to the YouTube Terms of Service and the YouTube API Services Terms of Service, as applicable.
Embedded YouTube and Twitch playback plus IGDB metadata lookups require separate in-product consent. If you decline, warmUP does not transfer data to those services for these features and shows a placeholder instead of loading embedded players on eligible surfaces. warmUP does not host, download, rip, or bypass YouTube or Twitch content.
Title logos for games in your library are optional and come from SteamGridDB. Choosing Allow title logos, in onboarding or in the Home prompt, is your agreement to these Terms and the Privacy Policy as they describe that feature. You can change the choice in Settings under Privacy. Showing a logo does not transfer any rights in it to you or to warmUP. Game names, logos, and artwork remain the property of their respective owners.
If you suggest a YouTube link for soundtrack preview or discovery, you may only submit links that you reasonably believe are lawfully uploaded by or with authorization from the relevant rights holders, such as an official publisher, developer, artist, label, or channel. Do not submit fan rips, unauthorized re-uploads, bootlegs, circumvention links, or links that violate YouTube rules or third-party rights.
Suggestions are non-binding. We may review, reject, remove, replace, or disable links at any time for legal, platform-policy, quality, safety, or product reasons. Rights holders can report problematic links at privacy@warmup-gamelauncher.com.
7. AI features
AI-generated product features may use OpenRouter and downstream model providers. AI outputs can be wrong, incomplete, unsafe, biased, or outdated. They are not professional advice and must not be relied on for legal, medical, financial, mental-health, emergency, or safety-critical decisions.
You must not submit passwords, API keys, payment card data, government IDs, protected health information, trade secrets, or other sensitive data to AI features. We may rate-limit, monitor, disable, or remove AI access to protect users, providers, infrastructure, or our legal interests.
8. Acceptable use
You agree not to misuse the Service, including by: violating law; infringing copyright, trademark, privacy, or publicity rights; harassing or harming others; submitting unlawful content; bypassing subscriptions or entitlements; attacking, probing, scraping, rate-limit evading, or reverse engineering systems except where permitted by law; interfering with ads or measurements; abusing AI features; or using third-party integrations contrary to their rules.
9. Store integrations and downloads
warmUP may help detect, import, launch, or download games through installed launchers, platform APIs, OAuth flows, or bundled open-source tools such as legendary, gogdl, and nile. You are responsible for having lawful access to any game, ROM, emulator, launcher, store account, subscription, or content you import or launch.
Third-party launchers, stores, games, emulators, anti-cheat systems, DRM systems, and platforms may change their behavior or rules. We do not guarantee compatibility, availability, entitlement recognition, download success, or uninterrupted launch behavior.
10. Anti-cheat systems and game accounts
Many online games use anti-cheat systems, for example Easy Anti-Cheat, BattlEye, Riot Vanguard, or RICOCHET, and set their own rules about which software may run alongside them. These systems and rules are operated by the game’s publisher, the platform, or the anti-cheat provider, not by us. warmUP is not designed to modify games or to give anyone a gameplay advantage, but we do not control how a third-party anti-cheat system classifies software running on your device, and those classifications can change at any time without notice.
We therefore do not guarantee that warmUP or any of its features, including launching, overlays, controller and input handling, window and display management, and capture, is compatible with or permitted by any particular game, anti-cheat system, or platform. Warnings, kicks, matchmaking restrictions, suspensions, bans, and the loss of in-game items, currency, or progress are decided by those third parties alone. We are not responsible for such decisions and cannot reverse them. Questions and appeals have to go to the respective publisher or platform.
You are responsible for following the rules of the games you play. If a game’s rules do not allow software or features like those in warmUP, turn the relevant feature off or close warmUP while playing that game. This section does not limit our liability where the mandatory-law carve-out in section 13 says it cannot be limited.
11. Intellectual property
The App, warmUP branding, UI, content, and original assets are owned by us or our licensors. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. Game titles, logos, artwork, videos, music, store marks, platform marks, and third-party assets remain property of their respective owners. Choosing Allow title logos is your agreement to these Terms and the Privacy Policy for that feature. warmUP is not affiliated with or endorsed by Nintendo, Valve, Sony, Microsoft, or other publishers, or by the Nintendo, Steam, PlayStation, Xbox, or other platforms.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, COMPATIBILITY, SECURITY, AND ERROR-FREE OPERATION.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST GOODWILL, SERVICE INTERRUPTION, DEVICE DAMAGE, THIRD-PARTY ACCOUNT ACTIONS, OR THIRD-PARTY CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR US $50, EXCEPT WHERE LAW DOES NOT ALLOW THAT LIMIT.
Mandatory law carve-out. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable mandatory law. In particular, for users subject to German law, the above disclaimers and limitations do not apply to liability for intent or gross negligence, for injury to life, body, or health, under the German Product Liability Act (Produkthaftungsgesetz), under any guarantee we expressly give, or for breach of essential contractual obligations (Kardinalpflichten); for slightly negligent breach of essential contractual obligations our liability is limited to the foreseeable damage typical for this type of contract.
14. Indemnity
To the extent permitted by applicable law, you will defend, indemnify, and hold harmless warmUP Game Launcher (sole proprietor: Levent Yakin) and its affiliates from third-party claims, damages, losses, liabilities, and expenses arising from your culpable breach of these Terms, your content or link suggestions, your violation of third-party rules, or your infringement of third-party rights. This obligation does not apply to the extent the matter is caused by us, and, for consumers subject to mandatory law, applies only to the extent such law permits.
15. Suspension and termination
We may suspend or terminate access to the Service or specific features if we reasonably believe you violated these Terms, created risk, abused infrastructure, infringed rights, failed payment, or used the Service in a way that may harm us, users, partners, or third-party providers. You may stop using the Service at any time. Sections that by nature should survive will survive termination.
16. Changes to these Terms
We may update these Terms and the Privacy Policy by posting a new effective date in the App or at https://www.warmup-gamelauncher.com/terms-of-service. When we change either document materially, the App asks you to accept the updated version before you can keep using it. This request cannot be skipped or closed: you either accept or decline.
If you decline, you are signed out and cannot use the Service until you accept the updated version. Declining does not cancel a paid subscription automatically. To cancel it, email billing@warmup-gamelauncher.com.
17. Governing law and disputes
Except where mandatory consumer protection law in your country of residence requires otherwise, these Terms are governed by the laws of Germany, excluding conflict-of-law rules. Venue for commercial disputes shall be the courts of Berlin, Germany, where permitted. Consumers may bring claims in their place of residence where EU or national law so requires.

19.1 Free download
Requesting the free download does not create any purchase obligation. We may use your email to process the download request and related support. Optional product updates by email are only sent if you give separate consent in the download flow. Pricing and features shown on this Site may change.
19.2 Creator / reward program
The creator program ("Make a Reel, get warmUP for free") lets you earn a discount or free access to the warmUP Plan by posting a public Reel about warmUP on Instagram or TikTok, tagging us, and using #warmUP. Reward tiers are based on organic view counts as described on the Creators page at the time of your submission.
- Views must be organic — no bots, paid promotion, or view manipulation.
- We may verify view counts, account authenticity, and content before granting any reward.
- We may decline rewards for suspicious activity, fake engagement, or content that violates these Terms.
- Rewards are applied as discounts or free periods on the warmUP Plan and have no cash value.
- The program, its tiers, and rewards may be changed or withdrawn at any time, including after a Reel is posted but before a reward is claimed.
- By submitting a Reel, you confirm you own or have rights to the content, and you grant us permission to view, reference, and (with credit) showcase it for promotional purposes related to warmUP.
19.3 Cancellation and withdrawal details
You can cancel a paid plan at any time. After the initial billing period, the contract continues for an indefinite term and can be terminated at any time with a notice period of no more than one month. You can cancel without signing in through our cancellation form. The withdrawal instructions, the model withdrawal form, and the effects of withdrawal (including reimbursement within 14 days) are set out in our Cancellation & Withdrawal Policy.
